1. Introduction and Acceptance

These terms of service ("Terms") constitute a legally binding agreement between you ("User", "you") and FeedbackHawk ("we", "us", "the Service"). By creating an account or using the Service, you accept these Terms in their entirety. If you do not accept the Terms, you should not use the Service.

If you use the Service on behalf of a company, you warrant that you have the authority to bind the company to these Terms.

2. Description of the Service

FeedbackHawk is a cloud-based service that helps businesses collect Google reviews through automated email requests to their customers. The Service includes features for managing customer lists, sending review requests, and tracking statistics on sent messages.

3. Restriction Regarding Sensitive Personal Data

FeedbackHawk is not designed to handle special categories of personal data under Article 9 of GDPR. By using the Service, you certify and warrant that:

a) Your business does not primarily handle sensitive personal data such as data concerning health, ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, sex life or sexual orientation.

b) The customer data you enter into the Service does not, through its context, reveal sensitive personal data.

c) You will not use the Service for businesses in healthcare, psychiatry, addiction treatment, sexual health, religious organizations, political parties, trade unions, or other businesses where the customer relationship itself reveals sensitive data.

Breach of this provision constitutes a material breach of contract and gives us the right to immediately terminate your account without refund.

4. Permitted Use

You agree to use the Service only to: send review requests to people who are actual customers of your business, contact customers who have an existing business relationship with you and where you have a legal basis for communication, follow Google's guidelines for reviews and user content, and act in accordance with applicable legislation, including GDPR and marketing laws.

The Service is intended for contacting customers after a completed visit to your business. Mass mailings to contacts who have not recently visited your business are not permitted and may result in account suspension.

5. Prohibited Use

The following use is strictly prohibited: sending unsolicited email (spam) to people who are not your customers, buying, renting, or otherwise using email lists from third parties, attempting to manipulate or fabricate reviews including offering incentives for positive reviews, sending content that is illegal, threatening, offensive, defamatory, or otherwise inappropriate, using the Service in a way that damages FeedbackHawk's reputation or technical infrastructure, giving access to your account to unauthorized third parties, and circumventing technical limitations or security measures in the Service.

6. Your Responsibility as Data Controller

When you use the Service to send emails to your customers, you are the data controller for those customers' personal data. This means you are responsible for having a legal basis for processing your customers' personal data, informing your customers that their data is being processed and for what purposes, ensuring you have the right to communicate with customers via email, and handling any requests from your customers regarding access, rectification, or deletion.

FeedbackHawk acts as a data processor and processes the data only according to your instructions to provide the Service.

7. Prices and Payment

Free: 20 emails at no cost.

Pro: 249 SEK per month for 1000 emails per month.

Payment is made in advance via Stripe. You can upgrade, downgrade, or cancel your subscription at any time. Upon cancellation, you have access to the Service until the end of the paid period. No refunds are given for partially used periods.

We reserve the right to change prices with 30 days' notice. Price changes take effect at the next billing period.

8. Availability and Support

We strive to make the Service available around the clock but do not guarantee any specific availability level. Planned maintenance is communicated in advance when possible. Support is provided via email in Swedish and English on weekdays.

9. Intellectual Property Rights

FeedbackHawk and all associated trademarks, logos, designs, and software belong to us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivatives of the Service.

10. Limitation of Liability

The Service is provided "as is". We do not guarantee that the Service is error-free, uninterrupted, or suitable for any particular purpose. To the extent permitted by applicable law, we disclaim all warranties, express or implied.

Our aggregate liability to you is in all circumstances limited to the amount you have paid for the Service during the past 12 months. We are never liable for indirect damages, lost profits, lost data, or consequential damages.

We are not responsible for the consequences of how recipients respond to your review requests or for the content of reviews that are written.

11. Suspension and Termination

We reserve the right to immediately suspend or terminate your account if you violate these Terms, particularly the provisions regarding sensitive personal data, permitted use, or prohibited use. For serious violations, no refund is given.

You can terminate your account at any time. Upon termination, all your data will be deleted within 30 days, except for data we are required to retain by law.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified via email at least 30 days in advance. Continued use of the Service after the changes take effect means you accept the new Terms.

13. Applicable Law and Disputes

These Terms are governed by Swedish law. Disputes shall primarily be resolved through negotiation. If the parties cannot agree, the dispute shall be decided by Swedish public courts with Stockholm District Court as the court of first instance.
